Welcome to The Probate Concierge. By using our services, you agree to the following terms and conditions. Please read them carefully. If you do not agree to these terms, you may not use our services.
1. Scope of Services
The Probate Concierge provides property management, estate inventory, and related services to assist with the probate process in Massachusetts. These services include but are not limited to:
Property maintenance and staging.
Asset cataloging and organization.
Support for selling or renting probate properties.
Our services do not include legal advice, financial planning, or representation in court. For legal matters, we recommend consulting with a licensed attorney.
2. Eligibility
Our services are available to individuals 18 years of age or older and authorized to act on behalf of an estate. By using our services, you confirm that you meet these requirements.
3. Fees and Payment
Fee Structure: Fees for our services will be outlined in a separate service agreement before work begins.
Payment Terms: Payments are due as specified in the agreement. Late payments may incur additional charges.
Refunds: Refunds for unused services will be handled on a case-by-case basis and as per the terms of the service agreement.
4. Confidentiality
We value your privacy and will handle all information related to your estate with the utmost discretion. We will not disclose sensitive information to third parties without your explicit consent, except as required by law.
5. Limitation of Liability
While we strive to provide the highest quality service, The Probate Concierge is not liable for:
Any legal, financial, or tax consequences arising from decisions made based on our services.
Issues related to the condition of the property that were undisclosed or unknown.
Delays caused by third parties, including contractors or legal representatives.
In no event shall The Probate Concierge or its affiliates be liable for damages exceeding the fees paid for our services.
6. Client Responsibilities
To ensure the best outcomes, clients agree to:
Provide accurate and complete information related to the estate.
Notify us promptly of any changes that may impact service delivery.
Cooperate with requests for access to the property or documentation.
7. Termination of Services
Either party may terminate the service agreement with written notice. Upon termination, any outstanding fees for completed work will remain due.
8. Dispute Resolution
In the event of a dispute, both parties agree to attempt mediation before pursuing legal action. Mediation will occur in Massachusetts, and any unresolved disputes will be subject to the jurisdiction of the Massachusetts courts.
9. Amendments to Terms
The Probate Concierge reserves the right to update these terms at any time. Clients will be notified of any changes that materially affect their use of services.
